This code covers activities carried out after crop harvesting, such as cleaning, drying, sorting, and treating seeds to prepare them for sale or storage. Essentially, if your business takes crops from farmers and processes them to be ready for use as seeds or for consumption, this is your code. However, it does not include actual harvesting activities or the production of oils.

Authorization procedure and Trade Register aspects for CAEN 0163

Companies wishing to carry out post-harvest and seed preparation activities, CAEN code 0163, must register with the Trade Register (ONRC) with the main or secondary object of activity. When submitting the registration application, a sworn statement according to Law 359/2004 must be completed, by which the administrator attests to compliance with the legal operating conditions. Depending on the specifics, additional permits may be required: for seed storage – an authorization from the Ministry of Agriculture and Rural Development (MADR) according to Law 321/2009; for chemical seed treatment – a notification to the National Commission for Chemical Products. At the time of tax registration, the tax vector is also requested, and the Tax Authority (ANAF) will assign the corresponding code. Any subsequent modification of this CAEN code must also be reported to the Trade Register (ONRC), with the applicable fees.

Regulatory framework, specific permits and control institutions

Post-harvest and seed preparation activities are regulated by Government Ordinance 49/2006 on the production, processing, control and certification of seeds. Economic operators must be authorized by the Territorial Inspectorate for Seed and Planting Material Quality (ITCSMS) within the Ministry of Agriculture and Rural Development (MADR). For seed storage facilities, compliance with technical and sanitary conditions is required, and for chemical treatments, Government Decision 1408/2008 on the management of hazardous substances applies. The main control is exercised by ITCSMS, but also by the Sanitary Veterinary and Food Safety Directorates (DSVSA) in the case of seeds intended for fodder. Non-compliance with authorization attracts fines from 5,000 to 10,000 lei, according to ITCSMS warnings.

Tax management, ANAF audit risk and specific accounting

Revenues from providing post-harvest and seed preparation services are classified as services in agriculture. VAT is applied at the standard rate of 19%, except when provided to individual farmers, who may apply the VAT on collection system. Expenses for seeds, chemicals and labor are deductible, but must be justified by documents: invoices, order forms, production sheets. There is a risk of ANAF audit regarding the reality of operations and the correct classification of expenses. Tax obligations include corporate income tax of 16% or microenterprise income tax, VAT and salary contributions. ANAF may control the classification under CAEN and the correctness of income declarations. Strict records of quantities of processed seeds, applied treatments and quality certificates are recommended.

What authorizations are required for seed preparation activities?

Depending on the type of seeds, registration with the National Phytosanitary Authority (ANF) may be required for the production and marketing of certified seeds. Also, if chemical substances are used for treatment, environmental regulations must be observed and an opinion from the Environmental Guard must be obtained.

Can I carry out harvesting and seed preparation activities under the same CAEN code?

No, harvesting is classified separately (code 0161 or 0162). To carry out both activities, you must have both CAEN codes registered, as they are considered distinct activities.
