When setting up a company that will carry out mobile food service activities, the main object of activity is registered with the Trade Register (ONRC) as CAEN class 5612. The registration application must be accompanied by a declaration on own responsibility according to Law 359/2004, by which the administrator confirms that the mobile unit (truck, trailer, tent) complies with technical, sanitary and fire safety standards. Building permits are not required, but it is mandatory to have a declared registered office (may be virtual). For preparation and marketing activities, registration with the Sanitary-Veterinary and Food Safety Directorate (DSVSA) is required, as well as obtaining an opinion from the Environmental Protection Agency, if the mobile unit generates waste or emissions. In the case of using a vehicle, an opinion from the Romanian Auto Registry (RAR) for special equipment is also required.

The performance of activity CAEN 5612 is regulated by Government Emergency Ordinance 99/2000 on the marketing of food products and Government Decision 984/2005 on sanitary-veterinary control. Mobile units are considered public catering points and must meet the hygiene conditions provided for by EC Regulation 852/2004. Mandatory endorsements include: sanitary operating authorization, environmental agreement (if applicable) and placement authorization issued by the town hall.
