ONRC will verify that the activity does not overlap with codes 4520 (auto maintenance) or 3312 (repair of industrial machinery). Consultant recommendation: add relevant secondary codes for related activities, such as 3311 (repair of metal articles) or 4532 (trade in parts).

Regulatory framework, specific approvals, and control institutions

Although CAEN 3317 does not require a standard mandatory approval at start-up, effective operation may require environmental permits (according to Government Emergency Ordinance 195/2005) if solvents, paints, or used oils are used – thus obtaining an environmental permit from the local Environmental Protection Agency is necessary. For repair of river/sea vessels, Law 191/2003 on civil navigation applies, requiring certification from ISCIR or another notified body. In the case of repairs to trams or metro wagons, authorization from the Romanian Railway Authority (AFER) is required. Main control institutions are: ISCIR, Environmental Guard, Territorial Labor Inspectorate (ITM) for occupational safety. Contracts with third parties must comply with the provisions of the Civil Code and Law 99/1999 on guarantees. For services provided to individuals, contracts with clear payment terms and penalties are recommended. From an accounting standpoint, expenses for consumables (welding, paints, spare parts) are recorded in variable expense accounts, and labor in account 602 – Material expenses. Depreciation of machinery (lifting gear, compressors) follows the fixed asset catalog, Group 2 – technological equipment. The ANAF audit risk is medium-high, especially if low revenues are declared relative to the space held or staff employed. Incorrect classification of services as auto repairs (code 4520) should be avoided to prevent sanctions. It is recommended to keep records of labor hours and technical sheets for each intervention for documentation in front of inspectors. The fiscal vector must be updated with ANAF to include code 3317, and if trade in parts is also conducted, code 4532 should be registered for application of the VAT on collection regime.
